ISV Real Estate and Construction (hereinafter “The Developer” or “We”), located at Km 178, Mexicali-San Felipe Highway, Baja California, México, is the entity responsible for the collection, use, protection, and processing of your personal data. We are committed to protecting the privacy of our clients and visitors in accordance with the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and its Regulations.

  • Financial & Patrimonial Data: Bank account details, proof of income, tax identification numbers (RFC or SSN), and credit history (specifically for clients applying for our internal owner financing).
  • Transactional Data: Information regarding the specific lot or “casita” of interest, payment schedules, and fideicomiso (bank trust) documentation.

2. Purposes of Data Processing

Your personal data will be used for the following purposes:

Primary Purposes (Necessary for the legal relationship):

  • To identify and verify your identity as a potential buyer or lessee.
  • To draft and execute legal contracts, including Promise of Trust Agreements, Purchase Agreements, and Lease Contracts.
  • To process payments and manage owner financing accounts.
  • Anti-Money Laundering Compliance: To comply with the Federal Law for the Prevention and Identification of Operations with Resources of Illicit Origin (LFPIORPI), which designates real estate transfer as a “Vulnerable Activity” requiring strict identification protocols.

Secondary Purposes (Marketing):

  • To send updates regarding construction progress at Rafael by the Sea.
  • To inform you of new inventory releases, price lists, or special promotions.
  • To conduct satisfaction surveys and improve our digital services.

3. Data Transfers

Your personal data may be transferred to third parties without your consent only when necessary by law or for the execution of a contract, including:

  • Public Notaries: For the ratification of signatures and deed processing.
  • Fiduciary Banks: To establish or transfer the Fideicomiso (Bank Trust) required for foreign ownership in the restricted zone.
  • Government Authorities: specifically the Tax Administration Service (SAT) and the Financial Intelligence Unit (UIF) for compliance with anti-money laundering reporting.

You have the right to Access your data, Rectify it if it is inaccurate, Cancel it if you believe it is no longer necessary, or Oppose its processing (collectively known as “ARCO Rights”).

While our operations are governed by Mexican law, we acknowledge the privacy standards of our international clients, including the California Consumer Privacy Act (CCPA). We do not sell your personal data to third parties for monetary value. US residents have the same rights to request deletion or portability of their data as outlined in the ARCO section above.

We implement administrative, physical, and technical security measures to protect your data against damage, loss, alteration, destruction, or unauthorized use. This includes limiting access to physical files at our KM 178 office and using encrypted digital storage for financial documents.
